For property acquisition and the referral program
1. Scope
These Terms and Conditions („Terms“) apply to the use of the website stayvie.de and to the contact options offered through it for property acquisition (proposing accommodation businesses for lease takeover) and for participation in the referral program of Stayvie UG (haftungsbeschränkt), Rathausgasse 5, 12529 Schönefeld, Germany („Stayvie“).
2. Description of Services
Via the forms embedded on this website (provided in part through monday.com), owners, investors, brokers and network partners may propose accommodation businesses for possible lease takeover by Stayvie. Submitting a form constitutes a non-binding inquiry and does not create a contract between the parties.
Stayvie reviews incoming proposals at its own discretion and will respond personally if interested. There is no entitlement to a response, to review within a specific timeframe, or to the conclusion of a lease agreement.
3. Conclusion of Contracts for Properties
A legally binding contract for the lease takeover of a property (lease agreement) is concluded exclusively through a separate written agreement between Stayvie and the respective owner or authorized party. Use of the website and its forms does not replace this process.
4. Referral Program
Individuals who bring a property to Stayvie's attention via the referral form that does not belong to them („Referrer“) may receive compensation upon successful placement. The amount of compensation is determined individually per property and agreed in writing between Stayvie and the Referrer before a contract is concluded.
A claim to compensation exists only if (a) the Referrer was demonstrably the first to bring the property to Stayvie's attention, (b) Stayvie had no prior contact with that property at the time of the referral, and (c) a lease agreement is actually concluded between Stayvie and the owner on the basis of that referral. Without a separate written compensation agreement, no claim exists.
5. User Obligations
Users agree to provide only truthful information in the forms and not to infringe the rights of third parties (in particular personal rights and data protection rights), for example when sharing the contact details of a property owner as part of the referral program.
6. Liability
Stayvie is liable without limitation for intent and gross negligence, as well as under the German Product Liability Act. For slight negligence, Stayvie is liable only in the event of a breach of a material contractual obligation (cardinal obligation), and limited to the foreseeable damage typical for this type of contract. Liability is otherwise excluded.
7. Data Processing
Information on the processing of personal data, in particular when using the embedded forms (monday.com) and WhatsApp contact, can be found in our Privacy Policy.
8. Final Provisions
These Terms are governed by the law of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
Should individual provisions of these Terms be or become invalid, the validity of the remaining provisions shall remain unaffected.
